Dalton dog owner sentenced after Jack Russell injured child

A Dalton dog owner has been sentenced after his Jack Russell injured a child on a public footpath.

Stephen Lanyan, 60, of Yarlwell Road, Dalton, was found guilty following a trial at South Cumbria Magistrates’ Court on July 10.

He was convicted of being the owner or person in charge of a dog that was dangerously out of control and caused injury.

The court heard that Lanyan’s ginger and white Jack Russell, named Dottie, was dangerously out of control on a footpath adjoining Yarlwell Road.

The dog injured a child during the incident. The child cannot be named for legal reasons.

District Judge Philip Holden found Lanyan guilty of the offence.

Dog must be muzzled and kept on a lead

Lanyan was given a 12-month conditional discharge.

This means he will not receive a further punishment for the offence unless he commits another crime during that period.

Judge Holden also imposed a contingent destruction order on Dottie.

Under the order, the dog must be kept on a lead and wear a muzzle whenever it is in a public place.

A contingent destruction order allows the dog to remain alive provided the owner follows the conditions set by the court. Failing to comply could place the animal at risk of being destroyed.

Compensation and court costs ordered

Lanyan was ordered to pay £200 compensation to the injured child.

He must also pay £650 in court costs and a £26 victim surcharge.

The total financial penalty was £876.
