Kendal man who never passed driving test banned for drink driving
A Kendal man who has never passed his driving test has been banned from the roads. Due to being caught driving while over the alcohol limit.
Kelvin Buckley was found behind the wheel of a silver Audi during the early hours of May 20.
South Cumbria Magistrates’ Court heard the 31-year-old was sitting in the driver’s seat with the engine running. The owner of the car was in the passenger seat.
Police boxed car in on Burton Road
Police officers boxed the vehicle in at a pedestrian crossing on Burton Road in Kendal.
Buckley was given a roadside breath test and arrested after returning a positive result.
The court heard his lowest breath reading was 59 micrograms of alcohol in 100 millilitres of breath. The legal limit is 35 micrograms.
Officers also found a small amount of cannabis inside the vehicle. Prosecutor Peter Kelly said it was consistent with personal use.
Buckley admitted four offences
Buckley, of Rinkfield in Kendal, pleaded guilty to:
- Driving with alcohol above the legal limit
- Using a vehicle without third-party insurance
- Driving otherwise than in accordance with a licence
- Possessing cannabis
The court was told Buckley had never passed his driving test.
Solicitor said journey was short
In mitigation, duty solicitor Shaun Harkin said the vehicle’s owner had driven for most of the journey.
He told magistrates Buckley had only driven a short distance and there were no other serious features.
Mr Harkin added that Buckley had no relevant previous convictions.
Driving ban and fine imposed
Magistrates fined Buckley £304 and banned him from driving for 16 months.
He was also ordered to pay £85 in court costs and a £122 victim surcharge.
The cannabis seized by police will be forfeited and destroyed.
